IMPORTANT: Please read this User Agreement carefully before using our remittance services. By registering an Account or submitting a transaction instruction, you confirm that you have read, understood and agreed to be bound by this Agreement in its entirety.

1. About This Agreement

This User Agreement is between Kathmandu International Traders Pty Ltd (ABN 59 621 215 959) trading as Prabhu Express and you, the individual registering to use our remittance services. This Agreement forms the entire legal agreement between you and Prabhu Express together with our Terms of Use and Privacy Policy. We may amend this Agreement at any time by publishing updates on our website. Continued use of our services constitutes acceptance of the revised Agreement.

2. Eligibility

• You must be at least 18 years old and a resident of Australia.
• You must hold valid government-issued photo identification.
• You must not be subject to sanctions or legal restrictions.
• Services are available to individuals only.
• We may refuse registration or transactions at our discretion.

3. Account Registration

You must register online via our transfer portal and provide accurate personal details, identification documents, email verification and Australian mobile number. You may hold only one Account. Your Account is personal and you must protect your login credentials. Notify us immediately if you suspect unauthorised access.

4. Identity Verification (KYC)

We verify your identity in accordance with the AML/CTF Act. We may use third-party verification services and conduct ongoing customer due diligence and transaction monitoring. Failure to provide requested information may result in suspension or closure of your Account.

5. Remittance Services

We provide international money transfer services exclusively from Australia to Nepal. Funds are paid to the nominated Beneficiary in Nepalese Rupees (NPR) through our correspondent partner. A binding contract is formed when we accept your transaction instruction.

6. Payment Method

Payments are accepted by electronic bank transfer only from your own Australian bank account. We do not accept cash, cards, cryptocurrency or third-party payments. Transactions are processed only after cleared funds are received.

7. Fees and Exchange Rates

Service fees and exchange rates are disclosed prior to processing. Exchange rates may fluctuate and may include a margin. We are not responsible for market fluctuations or third-party bank charges.

8. Cancellation and Refunds

Accepted transactions cannot normally be cancelled. In limited circumstances, we may attempt recall prior to payout. Approved refunds are returned to your nominated bank account.

9. AML/CTF Compliance

You warrant that all funds are lawfully obtained and not connected to illegal activity. We may report suspicious matters to AUSTRAC without notifying you. We may refuse, delay or block transactions to comply with legal obligations.

10. Your Responsibilities

• Provide accurate and current information.
• Use services only for lawful purposes.
• Ensure Beneficiary details are correct.
• Maintain account security.
• Comply with Australian laws.

11. Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss, exchange rate fluctuations, delays beyond our control, or incorrect information provided by you. Liability is limited to the value of the relevant transaction.

12. Suspension and Termination

We may suspend or close your Account if you breach this Agreement, provide false information, or if required by law. You may close your Account by written notice.

13. Privacy

Personal information is handled in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy. Information may be disclosed to regulatory authorities and our correspondent partner as required.

14. Governing Law

This Agreement is governed by the laws of New South Wales, Australia. Disputes are subject to the jurisdiction of the courts of New South Wales.
